Erie police officer withdraws guilty plea in off-duty fatal DUI

After months of delays leading up to her scheduled sentencing, a suspended Erie police officer extended her criminal case on Thursday by withdrawing her guilty plea to charges she caused an off-duty fatal crash while driving drunk in McKean Township in February 2017.

Cheryl A. Frey, 47, withdrew the plea after Erie County Judge Daniel Brabender granted her request, which she made just as her sentencing was to start. Brabender put the case on the trial list.

The Erie County District Attorney’s Office did not object to the withdrawal of the plea, but Assistant District Attorney Jeremy Lightner told Brabender that “the commonwealth is frustrated but frankly not surprised.”

Frey’s sentencing was postponed seven times following requests from defense lawyer Andrew Sisinni for additional information about the victim in the fatal crash, Wade A. Schulze, 57, including his speed at the time of the crash and his cell phone records.

I hired Eric for someone who was facing serious felony charges. He is a fairly young man with a young child who he absolutely adores.
