ERIE, Pa. — An Erie man accused of escaping from custody waived his preliminary hearing Wednesday as charges filed against a relative accused of assisting in the escape were dismissed.
Todd C. Wiley, 20, charged with escaping from a constable who was preparing to take him to the Erie County Prison from Erie 6th Ward District Judge Dominick DiPaolo’s court on Feb. 22, waived his hearing before Erie 2nd Ward District Judge Paul Urbaniak on misdemeanor counts of escape, flight to avoid apprehension and escape.
Wiley was about to be taken to prison to begin serving a 90-day jail sentence on a driving under suspension charge when he escaped from the constable and fled the West 38th Street court, investigators said.
Wiley remains in prison on $50,000 bond in the case. He is also in prison on another bond on charges of running from city police who tried to apprehend him in the escape case on Feb. 29, and possessing quantities of suspected crack cocaine that officers said they found in an abandoned car.
Also charged by Erie police in the escape case was Wiley’s relative, Shelby A. Wiley, 42, whom they accused of helping Todd Wiley in his flight from custody. But Urbaniak dismissed charges of permitting or facilitating escape, flight to avoid apprehension and conspiracy to escape after her preliminary hearing.
